National Fidelity Financial Privacy Policy


This Privacy Policy (this "Policy") of National Fidelity Financial ("National Fidelity Financial," "NFF," "we," "us," or "our") describes how we collect, use, disclose, and safeguard personal information in connection with our consumer debt settlement and debt relief services and related loan options (collectively, the "Services"). This Policy is a provider notice intended to inform you about our privacy practices. It is not a contract and does not create any contractual rights or obligations.

 

This Policy applies to information collected both offline (including by phone, mail, and in documents or applications) and online through websites owned and controlled by NFF at www.nfdebt.org and www.nfdebtrelief.org (together, the "Websites"). Unless NFF states otherwise, this Policy does not apply to affiliates that are not operating the Websites or providing the Services described here; such affiliates may maintain their own privacy notices applicable to their products, services, or websites.

 

Effective Date: 3/1/2026

 

We may update this Policy from time to time. When we do, we will post the updated Policy on the Websites with a new effective date. Where required by law, we will provide additional notice or obtain consent for material changes.

 

This Policy applies to NFF’s current and former consumer customers. By using the Websites or the Services, or by providing personal information to us, you acknowledge that you have received this notice.

 

For purposes of this Policy, "Personal Information" (also referred to as "Nonpublic Personal Information") means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal Information includes, for example, identifiers, contact details, and financial and credit information described in this Policy. "Sensitive Personal Information" means a subset of Personal Information to the extent collected by NFF, such as Social Security number, driver’s license or other government identification number, financial account information combined with access credentials, and precise date of birth, as those terms are used in applicable California law.

 

1. Key Terms.  The key terms "Personal Information" and "Sensitive Personal Information" are defined in the Introduction and used consistently throughout this Policy.

 

2. Personal Information NFF Collects.  We collect Personal Information in the course of providing the Services and operating the Websites, including:

(a) Information you provide directly. We collect information you provide to us offline (by phone or mail, or in documents or applications) and online (via the Websites), including your name, postal address, email address, telephone number, date of birth, Social Security number, income and employment information, details about your debts and creditors, and any other information you choose to submit during calls, in web forms, applications, or other documents.

(b) Information about your transactions and accounts. We collect information about your accounts and transactions, such as account balances with creditors, payment histories, account activity, information contained in credit card statements, settlement offers, and other reports or records relating to your debts and obligations.

(c) Information from consumer reporting agencies and other sources. We receive information from consumer reporting agencies (credit bureaus), collection agencies, creditors, lenders, and other third parties, including information regarding payment history, creditworthiness, credit standing, credit capacity, income, employment, and ability to satisfy obligations, as well as communications from your creditors, collectors, and lenders.

(d) Information collected automatically on the Websites. When you visit the Websites, we and our service providers may automatically collect certain information from your browser or device, including internet protocol (IP) address, device and browser type and settings, device identifiers, pages viewed, links clicked, and general activity on the Websites. We and our service providers use cookies, web beacons, and similar technologies for security, site functionality, analytics, and to improve the Services. If we use analytics or similar online tools, they are engaged as our service providers or processors and are not permitted to use Personal Information collected on our behalf for their own independent purposes. We do not enable cross-context behavioral advertising, as further described in Sections 6 and 7.

(e) Sources summary (for California CPRA purposes). We collect Personal Information from: you directly; your creditors, collectors, and lenders; consumer reporting agencies; our service providers and contractors (such as IT and analytics vendors); and, where applicable, NFF affiliates.

 

3. How NFF Uses Personal Information.  We use Personal Information for the following purposes:

(a) Primary business purposes. We use Personal Information to provide and service our debt relief programs; evaluate eligibility for the Services; process, administer, and manage accounts and transactions; communicate with you about the Services; respond to inquiries and requests; and provide customer service and support.

(b) Operations and improvement. We use Personal Information to conduct analytics relating to the performance of the Websites and the Services; improve, maintain, repair, and develop the Websites and the Services; maintain information security and prevent, detect, and investigate fraud or other illegal activities; and comply with applicable laws, regulations, and legal process.

(c) Marketing our own services. We may use Personal Information to market or promote NFF’s Services to you and to identify or prescreen customers for programs offered by NFF and, where permitted by law, by NFF’s affiliates or business partners. We do not use Sensitive Personal Information for additional purposes beyond those permitted by applicable California law.

(d) Automated decision-making. Other than routine evaluations tied to program eligibility and standard credit or risk assessments, NFF does not engage in automated decision-making or profiling that produces legal or similarly significant effects about you. If that changes, we will disclose the nature of such activities and your rights as required by law.

 

4. How NFF Discloses Personal Information (Sharing/Disclosure).  We disclose Personal Information as follows, subject to applicable law:

(a) To carry out requested services and transactions. We disclose Personal Information to creditors, credit card companies, collection agencies, banks, payment processors, settlement administrators, and other persons and entities as reasonably necessary to effect, administer, or perform the Services you request or authorize.

(b) To NFF’s affiliates and business partners. Where permitted by law, we may disclose Personal Information to NFF’s affiliates and to selected business partners to identify and prescreen customers for programs that may benefit them, and for related compliance, reporting, and servicing purposes. We require that such parties handle Personal Information in compliance with applicable law and with contractual privacy, confidentiality, and security obligations. Note: If NFF uses or shares "eligibility information" (as that term is used in the Fair Credit Reporting Act) received from an affiliate for the affiliate’s marketing, FCRA affiliate marketing rules may require a specific affiliate marketing opt-out and periodic renewal. If and when applicable, NFF will provide a separate affiliate marketing notice and opt-out.

(c) To service providers and contractors. We disclose Personal Information to vendors that perform services for us, including data processing, information technology, hosting, analytics, mailing, customer support, payment processing, and marketing performed on NFF’s behalf. We contractually restrict these parties to use Personal Information only to perform services for NFF and to implement appropriate administrative, technical, and physical safeguards.

(d) For legal, compliance, and safety purposes. We disclose Personal Information as necessary or appropriate to comply with law; respond to subpoenas, court orders, regulatory requests, and other legal process; protect our rights, property, and safety or those of our customers and others; and detect, prevent, or investigate suspected fraud, security incidents, or violations of law.

(e) Corporate transactions. We may disclose Personal Information in connection with or during negotiations of any proposed or actual merger, acquisition, divestiture, restructuring, reorganization, financing, sale, or transfer of all or a portion of our business or assets (including in connection with bankruptcy or similar proceedings).

(f) Aggregated and de-identified information. We may use and disclose aggregated or de-identified information that does not identify an individual, consistent with applicable law.

(g) No sale or share under California law. We do not "sell" or "share" Personal Information as those terms are defined by the California Consumer Privacy Act, as amended by the CPRA. In particular, we do not disclose Personal Information for cross-context behavioral advertising and do not allow third parties to use Personal Information collected on our behalf for their own independent purposes.

(h) No data broker practices. We do not disclose Personal Information to unrelated third-party data brokers for their independent resale or commercialization.

 

5. How NFF Protects Personal Information and Data Retention.  We employ reasonable administrative, technical, and physical safeguards designed to protect Personal Information, including employee training, access controls based on business need-to-know, and safeguards that meet or exceed applicable industry and regulatory standards. While no method of transmission or storage is completely secure, we work to protect Personal Information against unauthorized access, use, alteration, and disclosure.

 

We retain Personal Information for as long as necessary to provide the Services, manage our business, and meet legal, regulatory, tax, accounting, or reporting obligations. Generally, we retain Personal Information for at least five (5) years after the customer relationship ends. We may retain Personal Information longer where required or permitted by law, to comply with recordkeeping requirements, to resolve disputes, to enforce agreements, or to protect our legal rights. When Personal Information is no longer needed for permitted purposes, we will securely dispose of it consistent with our retention and information security policies and applicable law.

 

6. Your Choices – GLBA-Style Opt-Out (To Limit Certain Sharing).  Applicable law may provide you with the right to opt out of certain disclosures of your nonpublic Personal Information.

(a) Scope of opt-out. You may opt out of our disclosures of your nonpublic Personal Information to certain affiliated and nonaffiliated third parties for their own independent marketing purposes. Your opt-out will not affect our ability to disclose information:

(i) to effect, administer, or enforce a transaction you request or authorize, or to service your account;

(ii) to maintain or service your accounts or process transactions;

(iii) for fraud prevention, security, or risk control;

(iv) to respond to court orders, legal investigations, or regulatory requests;

(v) as otherwise permitted or required by law; or

(vi) to perform joint marketing with other financial institutions where permitted by law.

A single opt-out election applies to all persons covered by your relationship with us and does not need to be repeated for the same relationship.

(c) Timing. For new customers, we may begin sharing information with certain parties for permissible purposes 30 days after sending this notice. For former customers, we may continue to share information as described in this Policy, subject to your opt-out where applicable.

(d) Affiliate marketing (FCRA). If NFF uses information received from an affiliate (eligibility information) to market to you, we will provide a separate affiliate marketing opt-out with a duration typically of five years and instructions for renewal, as required by the Fair Credit Reporting Act. If we do not engage in such affiliate marketing practices, this provision does not apply.

 

7. Your Online Privacy: Cookies, Analytics, and Do Not Track.  This Section applies to the Websites at www.nfdebt.org and www.nfdebtrelief.org.

(a) Technologies used. We and our service providers use cookies, web beacons, and similar technologies to enable site functionality, maintain security, perform analytics, and improve the Websites and the Services.

(b) Your controls. Most web browsers allow you to set your preferences regarding cookies, including to refuse or delete cookies. If you disable cookies, some features of the Websites may not function properly.

(c) Analytics and advertising tools. If we use analytics tools (for example, Google Analytics), we engage those providers as our service providers or processors and contractually restrict them from using Personal Information collected on our behalf for their own independent purposes. Because NFF does not "sell" or "share" Personal Information, we configure any online tools to avoid cross-context behavioral advertising, such as by restricting data processing or disabling features that would constitute "sharing," or by using only contextual advertising.

(d) Do Not Track. The Websites do not currently respond to browser "Do Not Track" signals.

(e) Global Privacy Control (GPC). If NFF begins selling or sharing Personal Information in the future, we will honor opt-out preference signals, including Global Privacy Control, and will provide a "Do Not Sell or Share My Personal Information" link as required by California law. As of the Effective Date, this is not applicable because we do not sell or share Personal Information.

 

8. California Privacy Rights (CCPA/CPRA).

(a) Applicability and GLBA exemption. Some Personal Information that we collect in connection with providing a financial product or service is exempt from the California Consumer Privacy Act and CPRA due to the Gramm-Leach-Bliley Act (GLBA) exemption. CPRA rights generally apply to Personal Information we collect outside the GLBA context (for example, certain website analytics or marketing data).

(b) Categories of Personal Information collected (last 12 months). Consistent with this Policy, we have collected the following categories of Personal Information in the last 12 months: identifiers (such as real name, postal address, email address, telephone number, Social Security number); customer records (such as application information and account details); commercial information (such as account activity and payments with creditors); internet or other electronic network activity information (such as website usage data); inferences derived from the foregoing (if created, generally limited and related to eligibility or interest in Services); and Sensitive Personal Information (such as Social Security number and date of birth).

(c) Sources. We collect Personal Information from you; from creditors, collectors, and lenders; from consumer reporting agencies; from our service providers and contractors; and, where applicable, from NFF affiliates.

(d) Business or commercial purposes. We collect and use Personal Information to provide and service debt relief programs; maintain and service accounts; process transactions; perform security and fraud prevention; conduct analytics and service improvement; and market NFF’s Services.

(e) Disclosures. We disclose Personal Information to service providers and contractors; to creditors, collectors, and banks to perform the Services; to affiliates and business partners as permitted; for legal and compliance purposes; and in connection with corporate transactions, all as described in Section 4.

(f) No sale or share. We do not "sell" or "share" Personal Information as defined by California law.

(g) Sensitive Personal Information. We do not use or disclose Sensitive Personal Information for additional purposes beyond those permitted by California law (such as to provide the Services, ensure security and integrity, short-term transient use, processing on behalf of NFF, or as otherwise permitted by regulation).

(h) Your CPRA rights. Subject to the GLBA exemption and other legal limitations, California residents may have the following rights with respect to Personal Information collected outside the GLBA context:

(i) Right to know and access the categories and specific pieces of Personal Information we have collected about you, the categories of sources, our business or commercial purposes, and the categories of third parties to whom we disclose Personal Information.

(ii) Right to obtain a copy of your Personal Information in a portable and, to the extent technically feasible, readily usable format.

(iii) Right to delete certain Personal Information, subject to legal exceptions.

(iv) Right to correct inaccurate Personal Information.

(v) Right to opt out of sale or sharing of Personal Information (not applicable because we do not sell or share Personal Information).

(vi) Right to non-discrimination for exercising CPRA rights.

(vii) Right to limit the use and disclosure of Sensitive Personal Information (not applicable beyond permitted uses, because we do not use Sensitive Personal Information for additional purposes).

If you submit a written request, please include "California Privacy Request" and your full name, mailing address, email address, and phone number. We will take reasonable steps to verify your identity (for example, by matching information you provide with information we maintain, or by requesting additional documentation). You may designate an authorized agent to submit a request on your behalf; we may require the agent to provide proof of authorization and may require you to verify your identity directly. We will respond to verifiable requests within 45 days, or notify you of a permitted extension of up to an additional 45 days (for a total of 90 days) where reasonably necessary. Certain statutory limits, exemptions, or exceptions (including the GLBA exemption) may prevent us from fully complying with your request.

 

9. Other State-Specific Notices.

(a) Vermont. For accounts with Vermont billing addresses, we treat your account as if you have opted out of sharing with nonaffiliated third parties, and we limit sharing with our affiliates as required by Vermont law. For joint marketing with other financial institutions, we may disclose only your contact information and transaction or experience information.

(b) Montana. We do not disclose your name or Personal Information other than to your own creditors or to National Fidelity Financial’s agents, affiliates, or contractors, except as permitted or required by law.

(c) Nevada. We maintain internal Do Not Call procedures as described in this Policy. Nevada residents may submit a request directing us not to sell certain covered information by calling 888-703-5495 or emailing info@nfdebt.org. 10. Children’s Privacy.  The Services and the Websites are not directed to children under 13, and we do not knowingly collect Personal Information from children under 13. If you are a parent or guardian and believe that a child under 13 has provided Personal Information to us, please contact us using the methods in Section 11, and we will take appropriate steps to delete the information consistent with applicable law.
